Minutes – April 1, 2019

Commissioner Wilson Presiding

1. Commissioner Wilson called the meeting to order at 9:00 a.m. in the Commissioners Room at the Courthouse.

2. Commissioner Wiens moved to approve the agenda with the addition of County Clerk Alicia Showalter for an executive session at 11:30 and the minutes of the March 25th session as prepared. The motion carried unanimously following a second by Commissioner McCloud.

3. There were no public comments.

4. Commissioners participated in a discussion session and included reports on getting quotes for concrete at the Law Enforcement Center, cutting of ornamental grass at the courthouse, the Omni Site project has been completed, possible claim for lightning damage, and quotes/claims for roof repairs.

5. Public Works Administrator Tom Robl appeared to present updates to the Commissioners. He presented a quarterly report for the Airport indicating takeoffs and landings.  Commissioners requested that contact be made with an engineering firm regarding hangars for the airport.  Tom reported on the Federal Fund Exchange and Rice County is eligible for $108,553.55.  Commissioner McCloud moved to enter into the Federal Fund Exchange with the State of Kansas for a 90% amount of $97,698.19.  Tom discussed sealing of asphalt roads which will require 8100 tons of material and discussed the road south of Raymond.  Commissioners will look at the road and make a decision in the near future.  Tom discussed the Local Road Safety Program and how the program works.  Recommendations will be made by the engineers that are contracted with the State of Kansas and recommendations will be considered at a future date.  Household Hazardous Waste Day will be from 9 a.m. to 1 p.m. on April 20th.  Tom reported that the department will return to 10-hour days beginning April 22nd.  Tom reported that his department has spent 99.5 hours on courthouse maintenance since January 1, 2019.

6. EMS/EM Director Greg Klein appeared to present updates to the Commissioners. There was discussion regarding covering jail health issues.  Further information will be obtained and reported at a session in the near future.

7. Commissioner McCloud moved to approve the payment of $70,963.66 to the City of Sterling for the sewer extension project and pay it from the NRP Administrative Fund. The motion carried unanimously following a second by Commissioner Wiens.

8. County Clerk Alicia Showalter requested an executive session. Commissioner McCloud moved to enter into executive session from 10:45 to 11:00 for a review of KCAMP Property and Liability Claims and will return to open session at 11:00 in the Commissioners Room at the Courthouse.  The motion carried unanimously following a second by Commissioner Wiens.

Commissioners returned to open session at 11:00 in the Commissioners Room at the Courthouse.

9. Commissioner McCloud moved to approve the Airport Lease Agreement between Rice County and Rob Challans for lease of the round top hangar. The motion carried unanimously following a second by Commissioner Wiens.

10. Commissioner Wilson moved to approve the Fixed Base Operator and Airport Manager Agreement with the rate of $1,800 per month for the operation of the airport. Commissioner Wiens seconded the motion. Commissioner Wilson and Wiens voted in favor of the agreement and Commissioner McCloud voted in the negative.  The motion carried.

11. Commissioner McCloud moved to adopt Resolution 8-2019 (Establishing a Schedule of Range of Salary for Elected Officials). The motion carried unanimously following a second by Commissioner Wiens.

12. Commissioner McCloud moved to adopt the 2019 Elected Official Schedule with the following changes:

Sheriff                                                             $   321.36
County Clerk                                               $1,031.03

Commissioner Wiens seconded the motion.  Commissioner McCloud and Wiens voted in favor of the motion.  Commissioner Wilson abstained.  The motion carried.  The salary increases will be effective April 5, 2019.

13. County Clerk Alicia Showalter addressed concerns regarding information being taken out of executive sessions that are of private personnel matters, could be HIPPA violations and could lead to possible lawsuits. These incidents become a liability of the Rice County taxpayers and she just wanted to be sure the Commissioners were aware.

14. Commissioner McCloud moved to enter into executive session from 11:40 to 12:00 for a non-elected personnel matter concerning results in a personnel investigation and would return to open session in the Commissioners Room at the Courthouse. The motion carried unanimously following a second by Commissioner Wiens. County Counselor Scott Bush was present for the session.

Commissioners returned to open session at 12:00 in the Commissioners Room at the Courthouse.

15. Commissioner Wilson adjourned the meeting.
