Minutes – October 15, 2018

All Commissioners Present
Commissioner McCloud Presiding

1. Commissioner McCloud called the meeting to order at 8:00 a.m. in the Commissioners Room at the Courthouse.

2. Commissioner Wiens moved to approve the agenda and the minutes of the October 1st session as prepared. The motion carried unanimously following a second by Commissioner Wilson.

3. There were no public comments.

4. Deputy Treasurer Cindy Dobbins appeared and requested an executive session. Commissioner Wiens moved to enter into executive session from 8:47 to 9:00 for a non-elected personnel issue concerning vacation.  The motion carried unanimously following a second by Commissioner McCloud.

Commissioners returned to open session.

5. Economic Development Director Stacy Clark appeared to present quarterly updates. Stacy presented letters of support for signature.  Commissioner Wiens moved to authorize the chairman to sign letters of support for Sterling Presbyterian Manor and Council on Aging for public transportation.  The motion carried unanimously following a second by Commissioner Wilson.  Stacy reported on the loan programs, budget status, tourism, continuing education, celebrations, public relations and strategic planning.

6. Public Works Administrator Tom Robl appeared to present updates to the Commissioners. Tom reported that Rice County was denied on the Off System Bridge program.  He reported on bridge #116 that floated away due to the recent flooding, other flooding damage, striping project update, and Local Road Safety program agreement.  Commissioners reviewed the agreement for the Local Road Safety program and have asked for the County Counselor to review.  The Commissioners will take action in the near future.

7. Noxious Weed/Planning & Zoning Director Levi Beaver appeared to take action on three Resolutions for Planning & Zoning.   Commissioners reviewed Resolution 19-2018 and Commissioners have asked for some revised language.

8. Commissioners reviewed Resolution 20-2018 (Conditional Use Permit for HDM Inc. Commissioners Wiens moved to approve Resolution 20-2018.  The motion carried following a second by Commissioner Wilson.  Commissioner McCloud abstained from the vote.

9. Commissioner McCloud moved to approve Resolution 21-2018 (Conditional Use Permit for David Nelson to operate a Special Event Venue at 2597 Avenue J). The motion carried unanimously following a second by Commissioner Wilson.

10. Commissioner Wiens moved to approve Resolution 19-2018 (Conditional Use Permit for Midwest Energy) to erect a communications tower at 1688 Avenue K to be used only by public sector. The motion carried following a second by Commissioner Wilson.

11. Commissioner McCloud moved to enter into executive session from 10:20 to 10:30 for attorney-client privilege. The motion carried unanimously following a second by Commissioner Wiens. County Counselor representative Mark Tremaine and HR Director Alicia Showalter were present for the session.

12. Michael Gillaspie, with Oneok, appeared to present updates on the Elk Creek Pipeline project.

13. Harlan Ebright appeared to discuss the purchase of a portion of land that is owned by Rice County. Commissioners must publish a resolution prior to approving the purchase. Commissioner Wiens moved to approve Resolution 18-2018 declaring surplus property and setting a public hearing.

The motion carried unanimously following a second by Commissioner Wilson.  Commissioners discussed the contract with Harlan in regards to the airport and landfill ground that is currently being cash rented.  The contract will be reviewed and further action will be taken in the near future.

14. Commissioner Wilson shared information with the other Commissioners from the KLPG Annual Meeting.

15. Sheriff Bryant Evans appeared and requested an executive session. Commissioner McCloud moved to enter into executive session from 11:42 to 11:50 for a non-elected personnel issue concerning pay. The motion carried unanimously following a second by Commissioner Wiens.  County Clerk Alicia Showalter was present for the session.

Commissioners returned to open session.

16. Shayla Grasser, Braeden Grasser, Wyatt Showalter, Kristi Showalter, and Jeremy Showalter appeared to present information regarding 4-H. Commissioner Wilson moved to sign the National 4-H Proclamation declaring October 7-13 as National 4-H Week. The motion carried unanimously following a second by Commissioner Wiens.

17. Commissioner Wilson moved to adopt Resolution 17-2018 (Local Disaster Emergency Declaration). The motion carried unanimously following a second by Commissioner Wiens.

18. Commissioner Wiens moved to approve the agreement with Professional Cleaning Technicians for cleaning services for the Courthouse per the contract and specifications. The motion carried following a second by Commissioner Wilson.

19. Commissioners received bids for the removal of 15 trees and trimming of 27 trees on the Courthouse lawn. The bids are:

CNB Tree Trimming                         $9,500.00
Affordable Tree Service               $23,900.00

Commissioner Wiens moved to accept the bid from CNB Tree Trimming for removal of trees at the courthouse in an amount of $9,500.00.  The motion carried unanimously following a second by Commissioner McCloud.

20. Commissioner McCloud moved to appoint Alice Prester to Cowley County Housing Authority Board. The motion carried unanimously following a second by Commissioner Wilson.

21. Commissioner McCloud adjourned the meeting.
